Terms of Service

Table of Contents

1. Definitions

"Company," "we," "us," "our" refers to Phoenix Voyages, a registered travel agency in Ontario, Canada (TICO Registration: 50028032).

"Guest," "you," "your" refers to any person booking or traveling with Phoenix Voyages.

"Cruise" refers to the luxury river cruise experience on the Rhine River.

"Porsche Experience" refers to all driving activities including track days, scenic drives, and expert instruction.

"Booking" refers to your confirmed reservation for travel services.

"Departure Date" refers to the scheduled start date of your cruise.

2. Acceptance of Terms

By making a booking, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you and Phoenix Voyages. We reserve the right to modify these terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

3. Booking and Reservations

3.1 Booking Requirements

  • All bookings must be made by individuals 18 years of age or older
  • You must provide accurate and complete information during booking
  • You are responsible for ensuring all information is correct before confirming
  • A valid credit card is required to secure your booking
  • Bookings are subject to availability and confirmation by Phoenix Voyages

3.2 Booking Confirmation

Upon receipt of your booking request and deposit, we will send a confirmation email within 48 hours. This confirmation will include your booking reference number, cabin assignment, cruise details, and payment schedule. Please review all information carefully and notify us immediately of any discrepancies.

3.3 Suite Assignment

Suite categories are guaranteed as booked. Specific suite numbers are assigned at our discretion and may be subject to change for operational or safety reasons. Requests for specific locations (deck, fore/aft, etc.) will be accommodated when possible but cannot be guaranteed.

4. Payment Terms

4.1 Deposit

A non-refundable deposit of $2,500 (in your selected currency - USD or CAD) is required at the time of booking to secure your reservation. Your booking is not confirmed until we receive your deposit payment.

4.2 Payment Schedule

  • A non-refundable deposit of $2,500 (in your booking currency - USD or CAD) is required at time of booking
  • Interim payment of 50% of the remaining balance is due by January 6, 2027
  • Final payment of the remaining balance is due by April 6, 2027
  • Payment reminders will be sent prior to each payment milestone
  • Failure to make payments on time may result in automatic cancellation
  • Late payment fees may apply for payments received after the due dates

4.3 Accepted Payment Methods

We accept major credit cards (Visa, Mastercard, American Express), bank transfers, and certified checks. All payments must be in CAD or USD. Credit card payments may be subject to processing fees.

4.4 Pricing

All prices are quoted in CAD or USD and are subject to change until your deposit is received. Prices include luxury suite accommodation, all meals, premium beverages, onboard amenities, and port charges. Prices do not include: airfare, travel insurance, shore excursions (unless specified), Porsche Experience packages, gratuities, and personal expenses.

5. Cancellation and Refund Policy

5.1 Guest-Initiated Cancellation

All cancellations must be submitted in writing via email to info@phoenixvoyages.ca. Cancellation fees are as follows:

  • More than 90 days before departure: Full refund minus non-refundable deposit
  • 61-90 days before departure: 50% refund of total amount paid
  • 31-60 days before departure: 25% refund of total amount paid
  • 0-30 days before departure: No refund
  • No-show or early departure: No refund

5.2 Processing Time

Approved refunds will be processed within 14 business days to the original payment method. Please allow additional time for your financial institution to process the credit.

5.3 Company-Initiated Cancellation

Phoenix Voyages reserves the right to cancel any cruise due to insufficient bookings (minimum 24 guests required), force majeure events, mechanical failures, or other circumstances beyond our control. In such cases, you will receive:

  • Full refund of all payments made, or
  • Option to transfer to an alternative departure date, or
  • Credit voucher valid for 24 months with 10% bonus value

6. Changes to Bookings

6.1 Guest-Requested Changes

Changes to your booking (name corrections, date changes, cabin upgrades) are subject to availability and may incur fees:

  • Minor name corrections (typos): No fee if requested within 24 hours of booking
  • Name changes: $250 CAD per name change, subject to availability
  • Date changes: Subject to availability and price difference, plus $500 CAD change fee
  • Cabin upgrades: Price difference plus availability
  • Changes within 60 days of departure may not be possible

6.2 Company-Initiated Changes

Phoenix Voyages reserves the right to make changes to itineraries, schedules, or accommodations for operational, safety, or weather-related reasons. We will notify you of significant changes as soon as possible. If changes are substantial, you may be entitled to cancel without penalty or receive compensation as determined by applicable regulations.

7. Travel Documents and Requirements

7.1 Passport Requirements

  • Valid passport required for all guests
  • Passport must be valid for at least 6 months beyond cruise end date
  • Passport must have at least 2 blank pages for entry stamps
  • Damaged passports may be rejected by immigration authorities

7.2 Visa Requirements

You are responsible for obtaining all necessary visas for countries visited during the cruise. Visa requirements vary by nationality. We will provide information about ports of call, but you must verify requirements with the appropriate consulates. Phoenix Voyages is not liable for denied boarding due to visa issues.

7.3 Driver's License (Porsche Experience)

  • Valid driver's license required for all Porsche Experience participants
  • International Driving Permit recommended for non-EU/North American licenses
  • License must be in Roman alphabet or accompanied by certified translation
  • Photocopies of licenses required upon embarkation

8. Health and Medical Requirements

8.1 Fitness to Travel

All guests must be in reasonable physical and mental health to participate in the cruise and activities. You must notify us of any medical conditions, disabilities, or special requirements at time of booking. Phoenix Voyages reserves the right to:

  • Refuse boarding to anyone deemed medically unfit for travel
  • Require medical certification for certain conditions
  • Disembark guests whose condition endangers themselves or others
  • Refuse participation in Porsche Experience for safety reasons

8.2 Pregnancy

Guests who are pregnant must not be more than 24 weeks pregnant at any time during the cruise. Medical certification may be required. Pregnant guests may not participate in Porsche driving activities.

8.3 Medical Facilities

Basic medical facilities are available onboard. For serious medical conditions, we may arrange shoreside medical care at your expense. We strongly recommend comprehensive travel medical insurance.

9. Travel Insurance

Travel insurance is STRONGLY RECOMMENDED. We highly recommend purchasing comprehensive travel insurance covering:

  • Trip cancellation and interruption
  • Medical expenses and emergency evacuation
  • Baggage loss and delay
  • Travel delays and missed connections
  • Pre-existing medical conditions (if applicable)

Phoenix Voyages is not responsible for costs incurred due to cancellations, medical emergencies, or other unforeseen circumstances that could be covered by travel insurance. Insurance should be purchased at time of booking for maximum coverage.

10. Porsche Driving Experience Terms

10.1 Eligibility Requirements

  • Minimum Age: 21 years old with valid license and 2+ years driving experience
  • Track Days: Minimum age 25 years for insurance purposes
  • License: Valid driver's license from home country required
  • Medical Fitness: Must be physically fit to participate in high-performance driving
  • Sobriety: Zero tolerance policy - no alcohol or drugs permitted

10.2 Safety Requirements

All participants must:

  • Attend mandatory safety briefing before driving
  • Follow all instructions from certified driving instructors
  • Use provided safety equipment (helmets, harnesses)
  • Comply with track rules and regulations
  • Report any vehicle issues or incidents immediately

10.3 Liability Waiver

All Porsche Experience participants must sign a comprehensive liability waiver acknowledging the inherent risks of high-performance driving activities. This waiver must be signed before participation.

10.4 Vehicle Damage

  • Basic insurance is included with damage deductible of €5,000 per incident
  • Optional Damage Waiver available for purchase (reduces deductible to €500)
  • Willful negligence, reckless driving, or rule violations void all insurance coverage
  • Guests are responsible for all damage costs if insurance is voided

10.5 Removal from Program

Phoenix Voyages and driving instructors reserve the right to remove any participant from the Porsche Experience for safety violations, reckless behavior, impairment, or non-compliance with instructions. No refunds will be issued for removal.

11. Guest Conduct and Behavior

11.1 Code of Conduct

All guests are expected to conduct themselves in a manner that does not endanger, offend, or inconvenience other guests or crew. Prohibited behavior includes:

  • Illegal activities or possession of illegal substances
  • Violence, threats, or harassment of any kind
  • Excessive alcohol consumption or public intoxication
  • Loud or disruptive behavior during quiet hours
  • Smoking in non-designated areas
  • Unauthorized access to restricted areas
  • Damage to ship property or equipment

11.2 Consequences

Phoenix Voyages reserves the right to refuse service, deny boarding, or disembark any guest who violates these terms or whose behavior threatens the safety, comfort, or enjoyment of other guests. No refunds will be issued for removal due to misconduct. Guests may be liable for damages, legal costs, and any expenses incurred due to their behavior.

12. Onboard Policies

12.1 Smoking Policy

Smoking is prohibited in all enclosed spaces including suites, restaurants, and lounges. Designated smoking areas are available on open decks. Electronic cigarettes and vaping devices must also be used only in designated areas.

12.2 Dress Code

  • Casual Elegance: Most evenings - dress pants/slacks with collared shirt or equivalent
  • Formal Nights: 2 formal evenings - suits or cocktail dresses recommended
  • Daytime: Smart casual attire
  • Porsche Days: Comfortable, weather-appropriate driving attire

12.3 Dining

All meals are included. Reservations are recommended for specialty dining experiences. Dietary requirements must be communicated at least 14 days before departure. While we make every effort to accommodate requests, we cannot guarantee all restrictions can be met.

13. Baggage and Personal Property

13.1 Baggage Allowance

  • Two checked bags per guest (maximum 23kg/50lbs each)
  • One carry-on bag (maximum 10kg/22lbs)
  • Oversized or overweight baggage may incur additional fees

13.2 Prohibited Items

Weapons, illegal substances, flammable materials, and other dangerous items are strictly prohibited. Confiscated items will not be returned.

13.3 Liability for Lost or Damaged Items

Phoenix Voyages is not liable for loss, theft, or damage to personal property unless caused by our gross negligence. Maximum liability is limited to $250 per item. We strongly recommend travel insurance covering personal belongings. In-suite safes are provided for valuables.

14. Limitation of Liability

To the fullest extent permitted by law, Phoenix Voyages' liability is limited as follows:

14.1 Third-Party Services

We act as agent for third-party service providers (ship operators, ground transportation, excursion providers). We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers.

14.2 Personal Injury

Phoenix Voyages is not liable for injury, illness, or death except where caused by our direct negligence. Participation in activities (including Porsche Experience) is at your own risk.

14.3 Maximum Liability

Our maximum aggregate liability for any claim is limited to the total amount paid for your booking. We are not liable for consequential, indirect, or punitive damages.

14.4 Exclusions

Phoenix Voyages is not liable for:

  • Delays, cancellations, or itinerary changes due to weather, mechanical issues, or force majeure
  • Missed connections or delays in transportation not provided by us
  • Loss, damage, or theft of personal property (except due to our gross negligence)
  • Expenses incurred due to travel delays, cancellations, or itinerary changes
  • Medical expenses or costs of medical evacuation
  • Immigration or customs issues

15. Force Majeure

Phoenix Voyages is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, hurricanes, severe weather)
  • War, terrorism, civil unrest, or threat thereof
  • Pandemics, epidemics, or government health emergencies
  • Government actions, restrictions, or advisories
  • Strikes, labor disputes, or port closures
  • Mechanical failures or technical issues
  • Supplier bankruptcy or cessation of operations

In force majeure events, we will make reasonable efforts to provide alternative arrangements or refunds, but we are not obligated to do so and are not liable for additional costs you may incur.

16. Complaints and Dispute Resolution

16.1 Complaints

Complaints must be reported immediately to ship staff or our customer service team while traveling. This allows us to attempt to resolve issues promptly. Written complaints must be submitted within 30 days of cruise completion.

16.2 Arbitration

Any disputes arising from these terms or your booking shall be resolved through binding arbitration in Ontario, Canada under the Arbitration Act. You waive any right to participate in class action lawsuits or class-wide arbitration.

16.3 Time Limit for Claims

Any claim against Phoenix Voyages must be filed within 6 months of the completion of travel or the incident giving rise to the claim, whichever is later. Claims filed after this period will be barred.

17. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles. Any legal action must be brought in the courts of Ontario.

Phoenix Voyages is registered with the Travel Industry Council of Ontario (TICO Registration: 50028032) and complies with all applicable Ontario travel industry regulations.

18. Additional Provisions

18.1 Privacy and Data Protection

Your personal information is collected and used in accordance with our Privacy Policy. By booking, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

18.2 Photography and Media

Phoenix Voyages may take photographs and videos during the cruise for marketing purposes. By participating, you grant permission for your likeness to be used in promotional materials. Please notify us if you wish to opt out.

18.3 Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Phoenix Voyages and protected by copyright laws. Unauthorized use is prohibited.

18.4 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

18.5 Entire Agreement

These Terms of Service, together with our Privacy Policy and your booking confirmation, constitute the entire agreement between you and Phoenix Voyages. Any prior representations or agreements not included herein are superseded.

18.6 Modifications

Phoenix Voyages reserves the right to modify these terms at any time. Changes will be posted on our website with the "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
